Event Description
Understanding the European Investigation Order is now a must for all criminal law practitioners. The new instrument has entered into force in 2017, and brought a dramatic change in obtaining evidence from another EU Member State for the purposes of a criminal proceeding. Following our seminar you will not only appreciate the novelties brought by the European Investigation Order but have the opportunity to discuss practical issues related to collecting evidence in cross border cases.
How will it help you?
The objective of this seminar is to improve practitioners understanding how the mutual recognition principle animating the European Investigation Order makes obtaining foreign evidence quicker and more efficient. A distinguished attention will be devoted how to formulate the request, what are the key points that the executing authorities of the other EU Member State undertaking the investigation measure need to be aware, and finally how to ensure that the obtained evidence will be admissible in before the competent court hearing the case.
In the class for presentation and discussion format first we will ensure that the European Investigation Order is fully explained, and based on this through case studies and group work we will seek to provide a practical insight to the instrument.
Who will benefit most?
Professionals working in the criminal justice system and law enforcement sector, defence lawyers, civil servants from national administrations will benefit the most from the training. A basic level of criminal law knowledge is required to genuinely benefit from the training. No prior preparation is needed to attend the course, although if you have the time to read the European Investigation Order beforehand you will be able to participate in the training more actively.
