Target group
This seminar addresses the needs of lawyers, judges and government legal representatives who apply European Union law in their work, and require a deeper understanding of different litigation procedures before the Court of Justice of the European Union and the General Court of the European Union. Other members of the legal and judicial professions, academics, and people working in national and European administrations who are involved in topics concerning the functioning of the European Courts will also benefit from this seminar.

Description
This seminar provides a practical approach to the European Court’s proceedings and deepens the participants’ knowledge of the different written and oral phases of the Courts’ procedures: how to draft the application; the response; the reply and the rejoinder; and how to prepare for the oral hearing. It will also set out how to plead in an appeal case and ask for legal assistance, so as to promote the quality of judicial protection in the European Union legal system, and to ensure speedy and smooth proceedings.

The programme mainly consists of discussions based on case studies and presentations of practical tips. The cases will relate to the most frequent situations in which an action is brought against the Member State; the Member State lodges a complaint against the Commission; and the Member States brings an action for annulment based on the infringement of the basic principles of the EU law or review of legality of the certain provisions.

Learning methodology
Experts from the Courts and experienced practitioners will provide participants with both, theoretical background information and practical examples from their daily work. Taking a practical approach and using real life examples, the seminar will discuss the written and oral proceedings, as well as the litigation strategy before the Court of Justice and the General Court from the perspectives of both, plaintiff and defendant.

The seminar includes interactive sessions, and besides standard PowerPoint presentations, video recordings and other material will also be used to give participants the greatest possible insight into the practice. A visit to the Court of Justice to attend a hearing is also included in the programme. 

Objectives
Participants will gain extensive knowledge about the litigation procedures before the EU Courts and a clear understanding of particular procedural aspects, practical problems and their role in the proceedings.
